procurement service.

LDID and its associated ADIs take their obligations concerning
data protection seriously and do not use technologies such as
cookies, and personal data such as IP addresses.

Lake District Intensive Driving Courses 'Terms & Conditions'
are listed below.

The terms & conditions represent the basis upon which
all driving tuition courses are offered to the public
by Lake District Intensive Driving (herein referred to as LDID).

On booking driving tuition courses with LDID
all pupils agree to abide by the terms and conditions below.

The LDID contract of service is between
the pupil concerned and the relevant ADI
who have agreed to abide by these terms and conditions .

Lake District Intensive Driving Courses
 'Terms and Conditions'.

1. Intensive Driving Courses General Information

i)  A deposit is to be payable to LDID when 
booking an intensive driving course. 
The deposit paid is NOT refundable in the
event of the pupil cancelling within
seven days prior to the start of the course
and once the relevant booking has been 
accepted and agreed by all three parties
LDID, the pupil and the ADI concerned
.

ii) The contract for the intensive driving course
is deemed to begin on the first day of the 
intensive driving course or date the pupil's 
deposit is paid, whichever is actioned first.

iii) When a Driving Vehicle & Standards Agency 
(herein referred to as DVSA) 
Practical Driving Test is included the 
intensive driving course will include 
the time taken to take the practical driving test 
(approximately 57 minutes).

iv) At the request of the pupil LDID is prepared
 to pay the DVSA Fee for the practical driving test 
on its account with the DVSA on behalf  of the
pupil who has booked a LDID intensive driving course.
This fee will be payable by the pupil 
including a £15 administration charge. 
This administration charge may be waived 
or reduced by LDID at its own discretion. 
In all cases the current DVSA Practical Driving Test Fee
is payable by the pupil.

v)  In the event of the deposit not being paid 
by the due date LDID reserve the right to 
cancel the pupil's intensive driving course. 
LDID reserve the right to cancel the pupil's 
DVSA Practical Test booking with the DSA 
where the DVSA Practical Driving Test Fee 
has not been paid within 5 working days
of the driving test date.

vi) The deposit payment to LDID by the pupil 
is deemed to be the pupil's agreement for 
the intensive driving course purchased 
to be conducted in accordance with 
the LDID terms and conditions.

vii) The main method of payment for LDID 
courses is by Bank Transfer although a
Credit Card option via PayPal is available.
No additional charges are made for Bank Transfers.
The LDID bank sort code and account number
is communicated to the pupil by email or sms.
In order to protect the interest of the pupil
all monies received from the pupil in respect of 
LDID courses
are held on a Pupil/Client Account 
and only transferred
to the relevant ADI's 
bank account the day prior to the

first day of the intensive driving course.

For all Credit / Debit card payments via PayPal 
an additional 3.8% handling charge will be applied
to cover the PayPal Charges. 
For example of an LDID invoice covering the 
DVSA Practical Driving Test Fee paid by LDID on 
the pupil's behalf of £62 will attract an additional £2.35 
to cover the PayPal charges making the total payment 
payable £64.35.

viii)  The Balance of the pupil's intensive driving course cost 
after the deposit is payable by the last working day before the 
course commences. LDID reserve the right not to commence
a pupil's intensive driving course until all it has been paid in full..

ix) LDID will provide a receipt to the pupil via email if requested.

x) If for any reason the ADi is not available to conduct
the intensive driving course as agreed LDID will do
its utmost to sub-contract the pupil's intensive
driving course out to another fully qualified ADI.
In this case the LDID Terms & Conditions will still 
apply to the pupil's intensive driving course.

.n) In the event of an intensive driving course 
or part thereof being cancelled, then no penalty
will be incurred providing that the LDID instructor
can source alternative work for the same training
period in question. If this is not possible the full training
fee for the said training period may (at the discretion
of the ADI) be charged in full. Therefore, to ensure the
ADI can source alternative work, the cancellation
of an intensive driving course will only be accepted
with a minimum of  7 working days (not including 
Saturday, Sunday or Bank Holidays). 
If less than 7 days notice of cancellation is given, 
the remaining intensive driving course fees 
MUST be paid in full without exception.
If payment is not paid in full, legal assistance will be
initiated to recover the said intensive driving course fees
Cancellation of any day within the intensive driving course 
may be postponed to a future date at the discretion of the ADI.

o) If a pupil decides to cancel their intensive driving course
before the said intensive driving course is completed or 
any part thereof it is agreed that neither LDID nor the ADI
will NOT refund any monies paid. However, as an act of
goodwill and at the ADI's discretion a future date or a 
discount towards a future intensive driving course within 
3 months towards the lost hours resulting from the cancellation
may be offered. Cancellation of any day within the time period
of the intensive driving course by the pupil for sickness or any
other reason will NOT without at least 24 hours notice be
refunded and will be treated in the same manner as the
cancellation of the course as described above.
Cancellation requests must be made in writing and emailed to 
ldidcourses@gmail.com or by SMS to LDID or the ADI.

p) If a pupil fails to complete their intensive driving 
course in full i.e. he/she does not complete
the full number of hours of driving tuition booked for the
intensive driving course, LDID reserve the right to
cancel the said pupils practical driving test without exception.

q) If a pupil does not respond to any communication
made by their allocated ADI, it is agreed that LDID reserves 
the right to cancel any driving lessons or driving test booked 
until communication is re-established by the pupil. 
Once communication has been re-established, the pupil's 
ADI will where possible and at the ADI's discretion re-schedule
any unused course hours providing there is sufficient time to do so.
 

r) If a pupil is absent without prior agreement with the allocated ADI, 
the absent time will be taken as part of the intensive driving course hours.

s) Where a pupil as self-booked a driving test with the DVSA
then is the sole responsibility of that pupil to check the current
status with the DVSA. The DVSA Practical Test date, time and
DVSA Test Centre are to be communicated to LDID and the ADI
to ensure it is included the date and time of the intensive driving 
course.It is recommended that the details of any DVSA Practical
Driving Test self-booked by the pupil is communicated to LDID prior
to any payment being made to LDID.. If an error is identified after
the deposit payment has been made, any pupil self-booking the DVSA 
Practical Driving Test agrees NOT to hold LDID accountable for 
any booking error made in respect of practical driving test dates/details.
Any such error made regarding driving course or DVSA Practical Driving
Test date, time and any other details will be deemed as being the sole
responsibility of the pupil concerned. Therefore a thorough check of any
practical test date and course details provided by LDID must be made
by the pupil concerned

t) It must be understood and LDID is a procurement service for pupils and
ADIs and as such receives monies from pupils which are placed in a Pupil/Client
bank account on behalf of the pupil concerned. Monies are only transferred to the
ADI allocated to the intensive driving course the working day (excludes Saturdays
and Sundays)prior to the course commencing.

u) All intensive driving courses are conducted within the relevant
DVSA Test Centre area. Where an intensive driving course includes
a DVSA Practical Driving Test it is agreed that the last 2-3 hours of
such course is utilised for: 
(i) driving to the relevant DSA Test Centre;
(ii) time taken for the pupil to sit their practical driving test and 
(iii) dropping the pupil off at their agreed drop off point once 
the practical test has finished.

v) Failure to comply with our cancellation policy will result in any 
intensive driving course or DVSA Practical Driving Test test booked by
LDID being charged in full inclusive of the DVSA fee paid to them.
Date of booking is effective from the date the pupil's practical driving test
is booked/deposit is paid to LDID.

NB. Please ensure you know what an intensive driving course consists
before purchasing one of our courses. Intensive driving courses are
an excellent way to learn to drive for some individuals, but others can find
them overwhelming. Finding that the course you have purchased is difficult
is not an acceptable reason to cancel.

2. Payment of Intensive Driving Course

As stated in item 6 above, a non-refundable deposit must be paid in advance
of any intensive driving course taking place. The remainder of the course fee
can be paid by either (i) bank transfer, no less than 7 days prior to the
intensive driving course commencement date; (ii) PAYPAL transfer 
(any additional costs associated by using PAYPAL must be paid by the pupil)..

3. Cancellation

In the event of an intensive driving course or part thereof being cancelled, 
no penalty will be incurred providing that LDID can source for the ADI concerned 
alternative work for the same training period in question. If this is not possible,
the full training fee for the said training period may, at the discretion of LDID and
the ADI, be charged in full. Cancellation of a short notice intensive driving
course(i.e. where start date is less than 7 days from date of booking), 
will NOT be possible and full payment of the booked intensive driving
course fees will be required. If payment is not paid in full, legal assistance
may be sought in order to recover the said intensive driving course fees.

If a pupil decides to cancel their intensive driving course before the said
intensive driving course is completed, it is agreed that LDID will NOT
refund any monies paid. However, as an act of goodwill LDID and the ADI
will gladly consider offering at their discretion further hours or a discount towards
any future intensive driving course booked by the said pupil within 3 months of the
cancellation of the intensive driving course. Each day of the intensive 
driving course requires 24 hours notice of cancellation. 
Failure to comply with our cancellation policy will result in any unused hours
of the intensive driving course being charged in full. 
Cancellation requests must be made in writing and emailed to 
LDID at ldidcourses@gmail.com.

4. Use of the LDID Tuition Vehicle

It is agreed and understood by any pupil on an intensive driving course with a DVSA Practical Driving Test booked either by the pupil or by LDID that the pupil meets the required standard of full driving competency and is driving in the opinion of the ADI conducting the course to the standard required by the DVSA and independent of the need for further tuition. In the interests of safety for the pupil, the ADI, the general public and DSA staff, ADI reserves the right to withhold the use of their tuition vehicle for the practical driving test if, in their opinion, your driving is actually or potentially dangerous. The practical driving test fee (currently £62) will be forfeited if your practical test is cancelled within three working days of the said test.

5. Time-keeping

All pre-agreed driving course days must commence/finish on times agreed
between pupil and the ADI. If the pupil is late for the course for any reason,
the time will start when the pupil arrives and finish at the ADI's discretion..
If the ADI is late, the time will be added on at the end of the day if convenient
or on the day following as suitable for the pupil. In situations where this isn't 
convenient for the pupil or if the course finishes with a DVSA Practical
Driving Test, then the ADI agrees to a refund of the time lost..

6. DSA Practical Driving Test Booking

(i) LDID in most cases will book and pay for a pupil's practical driving
test appointment on its account with the DVSA. Te DVSA conduct driving
tests on week days only Monday to Friday
. Where LDID has made the
practical driving test booking on its account with the DVSA the current 
DVSA fee plus a 15% administration charge wil be made by LDID to the pupil.

(ii) If a situation arises that the ADI is absent on the day of the pupil's
practical driving test, the ADI agrees to refund the DVSA practical
driving test fee. This can ONLY be done after the said pupil demonstrates
 driving to the standard required by the DVSA and is driving independently
without the need for further driving tuition in the opinion of the ADI.

It's a requirement that the intensive driving course is completed.
The case may arise where the ADI  believes the pupil is not driving
safely and independently and to the standard required by the DVSA.
In this case the ADI will discuss the situation with the pupil with a view
to the driving test NOT being taken. It is hoped that the pupil is in 
agreement with the ADI and the ADI will inform the DVSA examiners
that the driving test will NOT be taken. If the pupil does NOT agree 
and wishes to take the practical driving test the ADI reserves the right
NOT to allow the tuition car to be used for the driving test.  

(iii) The management of a pupil's self-booked DVSA Practical Test
in all aspects is solely the responsibility of the pupil.

(iv) In the event of a pupil changing the date, time or DVSA Test Centre
for a practical test appointment this must be communicated to LDID
in writing at the following email address LDIDcourses@gmail.com. 
It is agreed that LDID and the ADI have the right to refuse to be 
involved with the pupil's revised DVSA Practical Driving Test appointment
if it is not convenient for the ADI, fall outside of the agreed dates for 
the intensive driving course or be such that the pupil would NOT
in the opinion of the ADI meet the requirement of driving safely,
independently and to the standard required by the DVSA. 

(v) To avoid any upset or distress, any pupil wanting a change of practical
driving test appointment in any aspect MUST seek approval from LDID
both verbally and in writing before any date change is implemented.

(vi) NO REFUNDS of the DVSA fee charged by the DVSA to the pupil when
the pupil booked the Practical Driving Test appointment will be 
made by LDID nor the ADI resulting from changes to the appointment
being made by the pupil.

.(vii) When a pupil books their own practical test date, LDID cannot and
will not be held responsible if a pupil provides LDID or theADI with
the incorrect test date and/or time or test centre details.
In these cases LDID and the ADI waive all responsibility.

7. DVSA Practical Driving Test Cancellation

Failure to provide the required notice of the candidate's intention to postpone
or cancel the DVSA Practical Driving Test Appointment without a least
three clear working days will result in the loss of the pupil's test fee.

LDID requires four clear working days notice in order to inform the DVSA
at least three clear working days of the notice of cancellation or
postponement required by the DSA.

LDID cannot be held responsible for any postponement or cancellation
of tests by the DVSA. The DVSA will do all that is possible to
arrange 
another test as quickly as possible and LDID and the ADI to their utmost
to assist the pupil in this event as well as with any to 
reclaim expenses from the DVSA.

8. Unsuitable Weather Conditions for Tuition or Test

All ADIs reserve the right to postpone or cancel any tuition if he/she 
feels that the weather or road conditions are unsuitable or dangerous
.
This also applies to the DVSA Examiner who will not conduct a
Practical Driving Test if he/she feels the weather or road conditions
are unsuitable or dangerous resulting from adverse weather. 
LDID and the ADI will reschedule any such tuition time at no 
additional cost to the pupil concerned. 
In the event of a DVSA Practical Driving Test being cancelled by the
DVSA Examiner this not within the control
of LDID nor the ADI
and therefore no additional time can be given or compensation made.
The DVSA have a compensation scheme in the event of a DVSA Examiner
not conducting the driving test.LDID will advise and assit the pupil
with a compensation claim accordingly.
It must be noted that LDID cannot be held responsible for costs
incurred by the pupil should he/she has to postpone any sessions with
the intensive driving course, for whatever reasons.

9. Complaints Procedure

Where any pupil has a complaint about any aspect of the intensive
driving course or the tuition being provided, the pupil is obliged to make
the complaint to the LDID and the ADI at the earliest possible time.
In the unlikely event of this not being resolved to the pupil's satisfaction
then the complaint must be emailed to LDIDcourses@gmail.com.

10. Your Statutory Rights

Your statutory rights relating to mis-described services provided by
LDID are not affected in the above mentioned Terms and Conditions.

LDID and its ADIs have a statutory requirement and obligation to
provide all of pupils on intensive driving courses with services fit for
the purpose for which they
were bought and as described.
You should contact your local Trading Standards Department or 
Citizen Advice Bureau where you have any doubts 
whatever about your statutory rights.
